Andhra Pradesh Civil Services (Conduct) Rules – Amendment to Rule 9 of Andhra Pradesh Civil Services (Conduct) Rules – Orders – Issued. 
GENERAL ADMINISTRATION (SERVICES-C) DEPARTMENT G.O.Ms.No.528 Dated:19-08-2008. Read the following:- 1. G.O.Ms.No.468, Genl. Admn. (Ser-C) Dept., Dated:17-04-1964. 2. G.O.Ms.No.471, Genl. Admn. (Ser-C) Dept., Dated:17-09-1994. 3. G.O.Ms.No.681, Genl. Admn. (Ser-C) Dept., Dated:11-09-2007. ***** ORDER: According to rule 9 (2) of the Andhra Pradesh Civil Services (Conduct) Rules, 1964 a Government employee who enters into any transaction concerning any movable property exceeding Rupees Fifty thousand in value, whether by way of purchase, sale or otherwise, shall forthwith report such transaction to Government or obtain prior permission. According to rule 9 (7) of the said Rules, every Government employee, other than a member of the Andhra Pradesh Last Grade Service and a Record Assistant in the Andhra Pradesh General Subordinate Service, shall on first appointment to the Government service, submit to Government a statement of all immovable property/properties irrespective of its value and movable property/properties whose value exceeds Rs.50,000/- owned, acquired, or inherited by him or held by him on lease or mortgage either in his own name or in the name of any member of his family, in the forms prescribed in Annexure – I and II separately. He shall also submit to Government before 15th January of each year, through the proper channel, a declaration in the forms given in the Annexure – I and II of all immovable / movable property / properties owned, acquired or inherited by him or held by him on lease or mortgage, either in his own name or in the name of any member of his family. 2. Government after examination have decided to enhance the present limit of Rs.50,000/- (Rupees Fifty Thousand Only) to Rs.1,00,000/- (Rupees One Lakh Only) and to amend the rule 9 (2) and (7) of A.P. Civil Services (Conduct) Rules, 1964 suitably. 3. The following notification shall be published in Andhra Pradesh Gazette:- NOTIFICATION In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and of all other powers hereunto enabling, the Governor of Andhra Pradesh hereby makes the following amendment to the Andhra Pradesh Civil Services (Conduct) Rules, 1964 issued in G.O.Ms.No.468, General Administration (Services–C) Department, dated the 17th April, 1964 as subsequently amended. Contd..p..2.. //2// AMENDMENTS In rule 9 of the said rules:- (1) in sub-rule (2), for the words “rupees fifty thousand”, the words, “rupees one lakh”, shall be substituted. (2) In sub-rule (7) (a) for the words and figures “Rs.50,000/-” the words, “rupees One Lakh” shall be substituted. Public Services – Disciplinary Cases – Violation of Andhra Pradesh Civil Services (Conduct) Rules – Initiation of disciplinary action as per Andhra Pradesh Civil Services (CCA) Rules – Orders – Issued.
GENERAL ADMINISTRATION (SERVICES-C) DEPARTMENT 
G.O.Ms.No.680 Dated:01-11-2008. 
ORDER : 
 All Government Employees are governed by the provisions of Andhra Pradesh Civil Services (Conduct) Rules, 1964. Any violation of the said rules amounts to mis-conduct and for such mis-conduct disciplinary action shall be initiated as per the procedure laid down in Andhra Pradesh Civil Services (CCA) Rules, 1991. 2. According to Rule 3 (1) of A.P.Civil Services (Conduct) Rules 1964, ‘every Government employee shall be devoted to his duty and shall maintain absolute integrity, discipline, impartiality and a sense of propriety’. 3. It is noticed that while initiating the disciplinary action against any erring employee the above rule position is not strictly adhered to. The charges against any erring employee shall be framed by the Competent Authority duly indicating the specific mis-conduct. Such articles of charge should not be vague and general in nature i.e., the words like slack supervision, irregular way of processing the issues etc., The Courts of Law are taking a view that there is no clear application of mind by the Competent Authority while initiating the disciplinary action against erring employee. The Division Bench of the A.P.High Court in K.David Wilson Vs. Secretary to Government, Law Department (2001 (5) ALT 65) held that “the charged official ought to be informed of the charges leveled against him as also the grounds upon which they are based. Charge of mis-conduct should not be vague. The charge-sheet must be specific and must set out all the necessary particulars and details irrespective of the fact whether the delinquent knows it or not, he must be told about the charges and it was not his duty to connect the charge sheet with his alleged understanding or knowledge of the charge. However, it is true that the charge need not be framed with the precision of a charge in criminal proceedings. But, at the same time, it must not be vague or so general as to make it impossible of being traversed. Therefore, the test is whether the charge conveys to the delinquent employee, the exact nature of the alleged mis-conduct in a way that would enable him to meet the charge effectively. It is well established that if a vague charge is given to a delinquent, it is a fatal defect, which vitiates the entire proceedings. It is also relevant to notice that the vagueness in the charge is not excused on the plea that the employee concerned should be deemed to have known the facts correctly. It should not be left to the delinquent official to find out or imagine what the charges against him are and it is for the employer to frame specific charges with full particulars.” 4. Thus, there is need to keep in mind the provisions contained in the Andhra Pradesh Civil Services (Conduct) Rules 1964, to check the misconduct of the Government employees to ensure that the system of administration functions smoothly. Government direct that wherever connivance, negligence, dereliction of duty of the Government employee is noticed, the Competent Authority shall take prompt action for such mis-conduct in accordance with the procedure laid down in the Andhra Pradesh Civil Services (CCA) Rules, 1991. 6. It is the earnest endeavour of the Government to ensure clean and efficient administration at all levels. 7. All Departments of Secretariat, all Heads of Departments and all District Collectors are requested to take prompt necessary action as per the above order.

In the G.O. 4th cited, orders were issued adding the words “Date of submission of Annual Property Returns and Signature of the individual” in Part-I of Form-A as Sl.No.4 to the existing modified Annual Confidential Reports for both Gazetted and Non-Gazetted Officers; and directed all the Departments of Secretariat, Heads of Departments and District Collectors to bring this format to the notice of all concerned to follow scrupulously. 3. In spite of the above specific instructions, it has come to the notice of the Government that some of the Departments are still using old formats of Annual Confidential Reports for both the Gazetted and Non-Gazetted Officers. 4. Therefore, all the Departments of Secretariat, Heads of Departments and District Collectors are once again requested to strictly follow the format of Annual Confidential Reports modified in G.Os 1st to 4th cited and bring it to the notice of all the concerned for strict implementation of the above instructions.  The Officer on Special Duty appointed by the Government to examine whether any amendments are required to various Acts and Rules relating to the conduct and discipline of Government servants has examined the provisions of the Andhra Pradesh Civil Services (Classification Control and Appeal) Rules, 1963, keeping in view of the suggestions made by the Commissioner for departmental enquiries and also of the Government, and then submitted a report to the Government. The Government after careful consideration of the suggestions made by him have decided to issue the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991, in super-session of the rules issued in the G.O, first read above as amended from time to time.
 2. The following Notification will be published in the Andhra Pradesh Gazette. ఫండమెంటల్‌ రూల్స్‌ - ఫిక్సేషన్‌, ఇంకిమ్రెంట్లు
ఒక ఉద్యోగి వేరొక పోస్టులో నియమించబడినపుడు లేదా ప్రమోషన్‌ పొందినపుడు ఫండమెంటల్‌ రూల్స్‌ 22, 30, 31 ప్రకారం అతనికి వేతన స్థిరీకరణ జరుగుతుంది. ప్రభుత్వం ప్రత్యేక ఉత్తర్వులు ఇచ్చిన సందర్భంలో బాధ్యత మార్పుతో సంబంధం లేకుండా ఈ నిబంధనల ప్రకారం వేతన స్థిరీకరణ జరుగుతుంది. సెలక్షన్‌ గ్రేడు, 6/12/18/24 సంవత్సరాల స్కేళ్లు, రివైజ్డ్‌ పే స్కేల్సు తదితరవాటిలో ఆ విధంగానే వేతన స్థిరీకరణ చేస్తారు. అలాగే ఉద్యోగి సర్వీసునుబట్టి ఇంక్రిమెంట్లు మంజూరు చేస్తారు. ఇంక్రిమెంట్ల మంజూరు, ప్రీపోన్మెంట్‌, పోస్టుపోన్మెంటు మొదలైనవి ఫండమెంటల్‌ రూల్స్‌ 24, 26, 27 ప్రకారం జరుగుతాయి.
ఎఫ్‌ఆర్‌-22(ఎ)(ఱ) : అదనపు బాధ్యతతో కూడిన పోస్టునందు నియమితులైనపుడు, నూతన స్కేలులోని తదుపరి స్టేజి వద్ద వేతన స్థిరీకరణ జరుగుతుంది. అలాంటి వేతన స్థిరీకరణ జరిగిన తేదీ నుంచి 12 నెలల సర్వీసు నిండిన తరువాత ఇంక్రిమెంటు ఇస్తారు.
ఉదా: 10,900-31,500 స్కేలులో రూ.11,860 వేతనం తీసుకునే ఉద్యోగి 14,860-39,540 స్కేలున్న పోస్టులో నియమించబడితే అతని వేతనాన్ని రూ.14,860గా స్థిరీకరిస్తారు.
ఎఫ్‌ఆర్‌-22(ఎ)(ఱఱ) : అదనపు బాధ్యతలేని పోస్టునందు నియమించ బడినపుడు, నూతన స్కేలులోని దిగువ స్టేజి వద్దనే వేతన స్థిరీకరణ జరుగుతుంది. అయితే...ఎ) పాత స్కేలులోని మూల వేతనానికి సమానమైన స్టేజి నూతన స్కేలులో ఉంటే, ఆ సమాన స్టేజి వద్దనే వేతన స్థిరీకరణ జరుగుతుంది. పాత ఇంక్రిమెంటు తేదీనే కొనసాగుతుంది.
ఉదా : 5470-12,385 స్కేలులో రూ.7,385 వేతనం పొందుతున్న ఉద్యోగి 7,200-16,925 స్కేలులో నియమితులైతే, అతని వేతనం రూ.7,385 వద్దనే స్థిరీకరిస్తారు.
బి) ఒకవేళ పాత స్కేలులోని మూల వేతనానికి సమానమైన స్టేజి లేకుంటే దిగువ స్టేజి వద్ద వేతన స్థిరీకరణ జరుగుతుంది. వేతన వ్యత్యాసం పర్సనల్‌ పేగా నమోదు చేస్తారు. పాత ఇంక్రిమెంటు తేదీ కొనసాగుతుంది.
ఉదా : 1,010-1,800 స్కేలులో రూ.1,360 వేతనం పొందుతున్న ఉద్యోగికి 1,280-2,440 స్కేలులో రూ.1,330+30 పిపిగా వేతన స్థిరీకరణ జరుగుతుంది.
సి) పాత స్కేలులోని మూలవేతనం నూతన స్కేలు మినమం కంటే తక్కువగా ఉంటే, మినిమం వద్ద వేతన స్థిరీకరణ జరుగుతుంది. సంవత్సరం సర్వీసు తదుపరి ఇంక్రిమెంటు ఇస్తారు.
ఉదా : 10,900-31,550 స్కేలులో రూ.11,860 వేతనం పొందుతున్న ఉద్యోగికి, 14,860-39,540 స్కేలులో రూ.14,360 వద్ద స్థిరీకరించబడుతుంది.

సీనియర్‌ స్కేలు ఎక్కువున్నా స్టెపప్‌ చేయవచ్చా?

సందేహాలు - సమాధానాలు
1. ఇద్దరు ఉద్యోగులలో ఒకరు 2002 సంవత్సరంలో ప్రమోషన్‌ పొందగా అతని వేతనము యఫ్‌.ఆర్‌. 22 (ఎ) (ఱ) ప్రకారము స్థిరీకరించబడినది. ఆ తదుపరి తేది 1-2-2009న స్పెషల్‌ గ్రేడు స్కేలు కూడా మంజూరైనది. కాగా జూనియర్‌కు 16 సంవత్సరాల స్కేలు మంజూరు తదుపరి తేది 20-5-2011న ప్రమోషన్‌ ఇవ్వబడినది. ప్రమోషన్‌ పోస్టు స్కేలులో అతని వేతనము యఫ్‌.22బి ప్రకారము స్థిరీకరించబడినందున జూనియర్‌ వేతనము ఎక్కువగాను, సీనియర్‌ వేతనము తక్కువగాను వున్నది. అయితే జూనియర్‌ స్కేలు తక్కువగాను, సీనియర్‌ స్కేలు ఎక్కువగాను వున్నది. అట్టి సందర్భములో సీనియర్‌ స్టెపప్‌ పొందుటకు అవకాశం ఉన్నదా? -వై.కిరణ్‌, సిరిసిల్ల, కరీంనగర్‌జిల్లా.
2010 వేతన సవరణ స్కేళ్లలో ఆటోమేటిక్‌ అడ్వాన్స్‌మెంటు స్కేళ్లకు సంబంధించి ఇచ్చిన జి.ఓ.93 నందు సీనియర్‌, జూనియర్‌ వేతన స్టెప్‌అప్‌ వర్తింపజేయుటకు విధించిన షరతులలో ''సీనియర్‌, జూనియర్‌ ఒకే వేతన స్కేలులో వుండాలి'' అనే షరతు మీరు పేర్కొన్న సీనియర్‌ వేతనమును స్టెప్‌అప్‌ చేయుటకు అడ్డంకిగా వున్నది. అయితే సీనియర్‌ వేతన స్కేలు ఎక్కువగా నున్న సందర్భములోను సీనియర్‌, జూనియర్‌ వేతన వ్యత్యాసమును సవరించడం సహజ న్యాయసూత్రాలకు అనుగుణమైనది గనుక ఆ మేరకు సవరణ ఉత్తర్వులు పొందుటకు ఉద్యోగ సంఘాలు ప్రాతినిద్యం చేయవలసి వున్నది.
2. ఒక ఎయిడెడ్‌ ఉన్నత పాఠశాలలో జూన్‌ 1989లో రికార్డు అసిస్టెంట్‌గా నియమించబడిన నేను సెప్టెంబర్‌ 1991లో జూనియర్‌ అసిస్టెంట్‌గా ప్రమోషన్‌ పొదాను. 2007లో 16 సంవత్సరాల స్కేలు తీసుకొన్నాను. 52 సంవత్సరాల వయసుగల నేను ఏ టెస్టులూ పాస్‌కాలేదు. 18 సంవత్సరాల స్కేలు పొందే అవకాశం వున్నదా? నేను తప్పనిసరిగా పాస్‌ కావలసిన టెస్టులేమైనా వున్నాయా? -ఆర్‌. మురళి, శ్రీకాకుళం.
రికార్డు అసిస్టెంట్‌గా నియమించబడిన ఉద్యోగి జూనియర్‌ అసిస్టెంట్‌గా ప్రమోషన్‌ పొందిన మీదట సీనియర్‌ అసిస్టెంట్‌గా ప్రమోషన్‌ పొందాలన్నా, లేక 16 సం||ల స్కేలు పొందాలన్నా సంబంధిత పార్టుమెంటల్‌ టెస్టులు పాస్‌ కావలసి వుంటుంది. ఎందుకనగా ఉద్యోగి సర్వీసుకాలంలో కనీసం ఒక ప్రమోషన్‌ పొందుటకుగాను అతనికి 45 సంవత్సరాల వయసు నిండి తేది డిపార్ట్‌మెంటల్‌ టెస్టులనుండి మినహాయింపు వర్తిస్తుందని జి.ఓ.యం.యస్‌.నెం.225 జిఎడి శాఖ, తేది 18-5-1999 నందు స్పష్టముగా పేర్కొనబడినది. కాగా 18 సంవత్సరాల స్కేలు పొందుటకు ఎట్టి అదనపు టెస్టులూ పాస్‌ కావలసిన అవసరం లేదు. 18 సంవత్సరాల సర్వీసు నిండిన మరుసటి రోజున 16 సంవత్సరాల స్కేలులోనే ఒక ఇంక్రిమెంటును కలుపుతారు.
3. మా కారుణ్యలయాధిపతి ''మీ విధులపట్ల ఉపేక్ష, అశ్రద్ధలతో వ్యవహరిస్తున్నారు గనుక మీపై క్రమశిక్షణా చర్యలు ఎందుకు తీసుకొనకూడదో సంజాయిషీ ఇవ్వండి'' అని మా సహచర ఉద్యోగికి నోటీసు ఇచ్చారు. ఈ అభియోగములతో సదరు ఉద్యోగిపై ఏ రకమైన క్రమశిక్షణగా చర్యలు తీసుకొనుటకు అవకాశమున్నది? -ఎ. నర్సింహం, సంగారెడ్డి.
  • మీరు పేర్కొన్న విధముగా సంజాయిషి నోటీసు ఇచ్చివుంటే, అందులో పేర్కొనిన అభియోగములలో స్పష్టత లేదు గనుక నేను స్పష్టమైన సంజాయిషీ ఇచ్చు కొనలేక పోతున్నారు.'' అని సదరు ఉద్యోగి కార్యాలయాధిపతికి తెలియజేసుకొనుటకు అవకాశం వున్నది. ఉద్యోగిపై మోపబడిన అభియోగములో స్పష్టత వున్నప్పుడు మాత్రమే సి.సి.ఎ. నిబంధనల మేరకు ఉద్యోగిపై క్రమశిక్షణా చర్యలు తీసుకొనుటకు వీలున్నది. సదరు విషయమై జి.ఓ.680 జిఎడి శాఖ తేది 01-11-2008 ద్వారా ఇచ్చిన వివరణ ఉత్తర్వులను పరిశీలించండి?
